Judge Hears Defense Motions in Hunter Biden Case

(LibertyInsider.org) – Hunter Biden is currently facing some legal woes stemming from his alleged failure to pay taxes in what prosecutors are calling a “four-year scheme.” He has been charged with several offenses, including failure to file and pay taxes, filing a false tax return, and tax evasion. His attorneys recently filed several motions to have them dismissed.

In a hearing on Wednesday, March 27, Biden’s legal team introduced several motions and argued that the charges against him were politically motivated and should be tossed. The charges were announced by special counsel David Weiss, who was appointed to the case by Attorney General Merrick Garland in August. Biden’s attorney, Abbe Lowell, said Weiss bowed “to Republican pressure” in bringing the charges against him, according to ABC News.

Prosecutors are looking to prove that Biden had the money to pay the taxes he owed, a sum of at least $1.4 million, but decided not to, instead spending on multiple extravagances. Those included payments to various women, adult entertainment, and clothing and accessories. “In short,” according to prosecutors, Biden paid for “everything but his taxes.”

The defense is seeking to toss out counts 1 through 4 on the merits that the charges were brought forth in the wrong venue, California, instead of Delaware or Washington, DC, where he was a resident in 2018. The judge in the case, Mark Scarsi, said the factual evidence was something for a jury to determine, noting that the courts were “hamstrung” in that regard.

Biden’s attorney, Kevin Morris, subsequently paid off his taxes. However, prosecutors decided to move forward with the charges against him. Biden, who did not attend the hearing, has pleaded not guilty to all counts, which include three felonies and six misdemeanor charges. If he’s convicted, he faces up to 17 years in prison.

Biden’s trial is currently scheduled to begin on June 20. Judge Scarsi is expected to rule on the above motions by April 17.
